Tanner Foust vs the decision of the Stewards of the Meeting in Holland.
Court of Appeal: After the Court of Appeal by its chairman Mr. C.G.C. Quarles van Ufford, in Holland (KNAF) has taking notice of the documents produced by the parties against the decision of the Stewards of the Meeting of August 14 during the European Rallycross Championship at Valkenswaard where upon a disciplinary penalty was imposed on the appelant (Tanner Foust) of regulation in the final judging.
The Court feels that a hearing cannot contribute to settlement the case. The Court has taken note of the appeal document lodged by the appelant on August 16, 2011 with supporting exhibits, including the underlying decision by the Stewards of the Meeting on august 14, 2011, against which the appellant had lodged an appeal. The Court notes that the appelant, represented by Mr. Andréas Eriksson, has certainly lodged his appeal in time, namely within two days following the Stewards of the Meeting decision, but at the same time that the appelant has neglected to lodge the appeal fee with the secretariat of the Court or with one of the other persons or bodies referred to in that article within the said appeal period of two days.
The Court therefore concludes that the appeal lodged by the the appelant cannot be declared admissible and the Court will no longer proceed with further consideration of the substance of the disputed decision.
The Court comes to the following decision:
- The appelant appeal be declared inadmissible.
- The protest and appeal fees be forfait to the KNAF.
- The appelant be ordered to contribute 250 Euro towards the cost of the procedure.
RallycrossWorld: This decision means that the ‘E’ [Exclusion] in the current point standings behind the name of American driver Tanner Foust must count in the standings for the European Rallycross Championship. And Foust has still one result to drop. At this moment it is not known if the team will go to appeal this decision. Foust lies, with three more races to go in the ERC, currently on third position. On top of the Supercars standings is reigning champion Norwegian Sverre Isachsen, followed by Russian driver Timur Timerzyanov. This year’s Supercar championship has seen five different winners in seven events, thereby, a lot is possible. One day you could be a winner, the next day you could be out of the finals. Even it’s a small change, a position in the top three is still possible for the with many European Rallycross fans popular American racer, and the next three events (Austria, Poland and the Czech Republic) are on tracks that Foust has not raced before. If the Rockstar driver decides to compete in next year’s ERC the next three round can give him valuable information about the venues, tracks, and conditions.
